Hacıabdullah Belde Mayor candidate Babaoğlan Altun, who swore at the gendarmerie commander at an association meeting in Istanbul, was disciplined by the AK Party Niğde Provincial Directorate with a request for definitive expulsion. ACTION WAS TAKEN AFTER ALTUN’S WORDS
Niğde central district Gendarmerie Commander went to the Niğde Chief Public Prosecutor’s Office and filed a complaint regarding Altun’s words. On the other hand, the AK Party Niğde Provincial Directorate took action, initiating a disciplinary investigation against Altun and demanding his definitive expulsion from the party.

Ersan Şen said, “The incident that took place here should be evaluated within the scope of Article 125 of the Turkish Penal Code. Here, the investigation and prosecution of the act of insult does not depend on the complaint. The penalty for insulting a public official due to his/her duty is from 1 year, 3 months to 2 years, 4 months, considering that the act in question is also committed publicly.” “It has been regulated as imprisonment for up to one month,” he said.

Stating that the lower and upper limits of the crime will be determined according to the intensity of the perpetrator’s intent, Şen continued his words as follows; “Here, the intensity of the intent of the act committed knowingly and willingly, insistently and by repeating words that may be subject to insult can be taken into consideration. If more than one insult has been committed, increasing the penalty from a chain crime will also be on the agenda. WHAT PUNISHMENT WILL BE GIVEN TO THE TOWN MAYOR CANDIDATE?
Lawyer Selahattin Par emphasized that insult crimes are punished in accordance with Article 125 of the Turkish Penal Code, and if the person insulted is a public official, the lower limit of the penalty imposed changes. Stating that a prison sentence of 3 months to 2 years is foreseen for insult crimes, Par said that this crime against an official performing public duty will be increased by 1/6 and the lower limit will not be less than 1 year.
WILL A LAWSUIT BE FILED AGAINST BABAOĞLAN ALTUN?
Answering the question of whether a lawsuit will be filed against the town mayor candidate Babaoğlan Altun, who swore at the gendarmerie commander, Lawyer Selahattin Par said, “Under normal circumstances, insult crimes depend on complaints. If the gendarmerie commander gives up his complaint, no lawsuit will be filed. In case of a complaint, he will be sentenced to at least 1 year in prison. If he has no criminal record.” “The sentence is postponed,” he said.
